Proxi Art Challenge

Official Rules


The Proxi Art Challenge described in these Official Rules will operate as a skills-based contest (the “Contest”). This Contest will be governed by the laws of the State of California and you consent to the exclusive jurisdiction and venue of the courts of the State of California for any disputes arising out of this Contest. If you do not agree with this provision and these Official Rules, please do not enter this Contest.
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED.

1) Parties.

This Contest is sponsored by Gallium Artistic Services Corporation dba Gallium Artists (“Gallium Artists”) and hosted by Unity Technologies ApS and its affiliates ( “Unity”), each of whom is identified in more detail in Section 11 and 12 respectively. The term “we” , “us” and “our” shall refer to Unity and Gallium Artists together. The terms “you” and “your” refers to an eligible individual entering the Contest. The term “Unity Software” refers to the Unity 2017 or Unity 2018 software.

2) Contest Description.

Will Wright, world-renowned game designer and creator of The Sims, SimCity, and Spore, has announced that his game dev studio, Gallium Artists, which was co-founded by Where in the World is Carmen San Diego creator Lauren Elliott, is working on its newest game, Proxi. Proxi, built in Unity Software, is a simulation game that allows players to build entire worlds from their personal memories. Gallium Artists is partnering with Unity to leverage the extensive pool of talent of the Unity Connect community to find a 3D artist to potentially help Gallium Artists create their next big game. In Proxi, memories are the building blocks of the world. They’re represented by piecing together 3D models to create different environments. In this Contest we are challenging you to create 3D art based on your own memories to enter the Contest, as described more fully below.

3) Timing.

The Contest entry begins at 12:01AM PT (00:01), Monday, March 19, 2018 (the “Start Date”) and you can enter the Contest until 11:59PM PT (23:59), Monday, May 14, 2018 (the “Deadline”). Judging will then commence but timing is subject to the number of entries received, however, potential winners shall be contacted within 10 days of completion of the judging phase. Winners of the Contest will be announced at the Unity Developers Conference, Unite Berlin 2018, taking place between June 19, 2018 and June 21, 2018 in Berlin, Germany (the “Announcement”).

4) How to Enter.

To enter the Contest, by no later than the Deadline:
  • You will need to create or have a Unity Connect profile and complete it to a minimum of 80% completion;
  • You will need to create and submit a “Project”, utilizing the Unity Software, which shall include

Video

  • Pick any three memories from your past that have a lot of meaning for you and render three environmental scenes based upon them (“Scenes”).
  • create one video featuring all of your Scenes and labeled with the personal memory (e.g. family, pet, travel, etc) that they represent and, if so desired and provided You have the rights thereto, incorporate animation, sounds, or music (“Video”).;

Article.

  • write one article (i) explaining your modeling process – how you set up each Scene in the Unity Software, including use of cameras, lighting, rigging, animation, sound, and post-procesing; (ii) a list of what tools you used to build the Scenes; and (iii) including work-in-progress images, videos, and GIFs showing your creative process; together (“Article”).
  • You will need to submit the Project at connect.unity.com/challenges/proxi
  1. add a Project Name;
  2. embed a public video of your final scene at the start of your entry;
  3. upload the Video & Article;
  4. add tags, and tag all uploaded content with #ProxiArtChallenge; and
  5. remember to share your submission on social media, as community winners will also be judged by the number of likes they receive.
Technical Restrictions.
  • You must have access to the Internet, Email account, and a personal computer;
  • You must have access to Unity Connect and a Unity Connect profile;
  • You must utilize Unity Software in the creation of the Project;
  • You may, but are not required to, utilize any rendering software of your choice (i.e. Maya, Blender, etc.) or any other Unity software.
  • The Project cannot: contain any models purchased from the Unity Asset Store or any other external marketplaces; have been submitted previously in a promotion of any kind; andhave been exhibited or displayed publicly through any means
Content Restrictions.
  • The Project must be your own original work; and be in English; you must have obtained any and all consents, approvals or licenses required for you to submit your Entry
  • The Project must not contain material that violates or infringes another’s rights, including but not limited to privacy, publicity or intellectual property rights, or that constitutes copyright infringement; defames, misrepresents, or contains disparaging remarks about people, companies, or products, is inappropriate, indecent, obscene hateful, tortious, defamatory, slanderous or libelous; promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation, or age; and is unlawful, in violation of or contrary to the laws or regulations in any jurisdiction where the Project is created.
Eligibility.
In order to be eligible to enter this Contest, as of at the time of entry:
  • You must be: an individual. No teams, companies, or similar group will be eligible to enter this Contest;
  • at least 18 years of age;
  • a legal resident in your place of residence;
You are NOT any of the following:
  • for U.S. export control reasons: a resident of Cuba, Iran, North Korea, Crimea, Sudan, or Syria;
  • a resident of Brazil; Dubai, United Arab Emirates; Italy; Quebec, Canada; or Saudi Arabia;
  • an employee of Unity or Gallium Artists or any of their respective parents, subsidiaries or affiliates;
  • an immediate family (parent, sibling, spouse, child) or household member of any person prohibited from entering this contest under criteria immediately above; and/or
  • a student, staff, or faculty of any university, college or other education institution entering in this Contest on behalf and/or in the name of your institution;
  • You must NOT have won a Contest prize from Gallium Artists or Unity within the last twelve (12) months.
Ineligible Entries. Entries generated by any means that violate these Official Rules, Unity’s Terms of Service, Unity Connect Terms and Conditions or Unity’s Privacy Policy are void and will not be accepted.
  • Entries will are illegible, incomprehensible, incomplete, or ineligible shall be disqualified at our sole discretion.
  • False, fraudulent or deceptive acts shall render you ineligible.
  • We reserve the right to terminate your eligibility to participate in this Contest or any other Contest run by either of us in the event of any ineligibility or disqualification for tampering or abuses.

Official Entry. We reserve the right to investigate and verify, conditionally reject, or reject outright any entry, in our sole and absolute discretion, that we determine does not meet the above criteria. A Project submission that complies with this Section 4 will be referred to as an “Entry”.

Consents. IF YOU DO NOT WANT TO GRANT US THESE RIGHTS TO YOUR ENTRY OR DO NOT AGREE TO THE STATEMENTS IN THIS SECTION 5, PLEASE DO NOT ENTER THIS CONTEST.
By submitting your Entry, you
  • acknowledge that you will not receive any compensation or credit for use of your Entry, other than what is described in these Official Rules.
  • grant Unity an irrevocable, royalty-free, worldwide right and license (with the right to sublicense and assign) to use your Entry and all content thereof for all reasonable purposes related to this Contest in all media whether now known or later developed.
  • acknowledge that we may have developed or commissioned materials similar or identical to your Entry and waive any claims you may have resulting from any similarities to your Entry;
By entering this Contest, you agree:
  • to be bound by these Official Rules and consent to Unity’s privacy policy (at https://unity3d.com/legal/privacy-policy), the Unity Terms of Service (at https://unity3d.com/legal/terms-of-service) and the Unity Connect Terms and Conditions (at https://connect.unity.com/public/terms/terms.htm);
  • that you will be separately bound by such additional terms and conditions which may be applicable to your use of the requisite technologies and/or materials described in these Official Rules;
  • to sign any necessary documentation that may be required for us to make use of the rights you granted above;
  • that our decisions will be final and binding on all matters related to this Contest; and
  • to receive regular communications from us specifically related to this Contest at the email address provided to us with your Entry.
Additional Terms.
  • Creation and/or submission of Contest materials through use of third party websites or tools may be subject to additional use terms as identified in such websites or tools.
  • Neither Gallium Artists nor Unity nor any of their respective affiliates, subsidiaries, advertising and promotion agencies, and each of their directors, officers, employees, agents and assigns, are responsible for lost, interrupted, or unavailable network server or other connections, miscommunications, failed telephone or computer transmissions, or technical failure, jumbled, scrambled or misdirected transmissions, or other errors of any kind whether human, mechanical or electronic or for phone, electrical, network, computer hardware or software program malfunctions, failures or difficulties, or for ISP/network/Web site accessibility or unavailability; any incorrect or inaccurate account information; any incorrect or inaccurate achievement information; human errors; technical malfunctions; theft, tampering, destruction, or unauthorized access to, or alteration of, accounts.
  • There is a limit of ONE (1) Entry per individual. Entries received in excess of this limit shall be disqualified.
  • In the event any portion of this Contest is compromised by virus, bugs, non-authorized human intervention or other causes beyond the control of Unity which, in the sole opinion of Unity, corrupts, or impairs the administration, security, fairness or proper participation in the Contest, Unity reserves the right at their sole discretion to suspend or terminate the Contest, and select Winners from participants’ accounts that can be determined by us to have not been compromised.
  • We reserve the right to suspend, change, or cancel this Contest for any or no reason.
Selection of Winners.
  • Determination of the Winning Entries. The winning entries will be determined as follows:
  • Grand Prize. Grand Prize winners shall be determined by judging panel, in accordance to the criteria below, and whose decisions shall be final and binding in all respects:
  • They shall judge each Entry on the following 100 point scale: up to X points for imagination and creativity, up to X for points thematic and stylistic cohesion, up to X points for quality, and up to X points for success at evoking a memory (“Judging Criteria”)
The Entries with the two highest scores shall be “Grand Prize Winners”, each Entry a “Grand Prize Winner”
  • Honorable Mention. Honorable Mention Prize winner, who are not Grand Prize Winners, shall be determined by number of likes received by the Unity Connect user community (“Likes”) in addition to the points from Judging Criteria as follows:
  • The six (6) Entries with the highest number of Likes which also rank within the top 50% of the highest point earners based on the Judging Criteria shall be “Honorable Mention Prize Winners”, each Entry a “Honorable Mention Prize Winner”
  • Ties. In the unlikely event of a tie, the entrant whose Entry received the highest score in the imagination and creativity category, as determined by the qualified judges in their sole discretion, will be deemed the applicable Grand Prize Winner or Honorable Mention Winner.
Winner. As used herein the terms “Winner” and “Winners” shall refer to an Entry who won a Grand Prize or Honorable Mention Prize and all Entries who won the same, respectively.
  • Odds of Winning. ODDS OF WINNING A PRIZE ARE SUBJECT TO THE TOTAL NUMBER OF ELIGIBLE ENTRIES RECEIVED.
  • Notification to Winners. Each Winner will be contacted via the email submitted with their Unity Connect Profile and may be announced at Unity’s discretion via Unity’s Twitter, Facebook, Blog, or Website, or in person verbally, such as on stage during a Unity event.
  • Any and all decisions of the Gallium Artists and/or Unity, including those of the judges, shall be final and binding in all respects.
PRIZES. To be clear, prizes are awarded in accordance with Section 6.
  • Prize Packages.
  • Grand Prize Winner Package. Winners who are Grand Prize Winners shall each receive:
  • a round-trip flights to the San Francisco, California, Bay Area (estimated retail value of $500 USD, if domestic, and $1,500 USD, if international);
  • a 2 night stay in hotel (estimated retail value of $500 per person USD);
  • a private dinner with Will Wright and contest judges (estimated retail value of $100 USD);
  • an interview with Will Wright and Gallium Artists team (estimated retail value of $0 USD);
  • a swag bundle: The Sims, Spores, Proxi T-shirts/games/stickers (estimated retail value of $100 USD); and
  • licenses (Allegorithmic, Marmoset) (estimated retail value of $300 USD).
  • Grand Prize Winner Package. Estimate Retail Value of between $500 to $1,500 USD.
  • Honorable Mention Prize Winner Package. Winners who are Honorable Mention Winners shall each receive:
  • a swag bundle: The Sims, Spores, Proxi T-shirts/games/stickers (estimated retail value of $100 USD); and
  • licenses (Allegorithmic, Marmoset) (estimated retail value of $300 USD)
  • Honorable Mention Prize Package. Estimated Retail Value of $400 USD
  • Estimated Total Prize Package Value. between $3,400 USD and $5,400.
All federal, state, local and or other applicable taxes, licenses, title and/or registration fees or others costs, associated with winning a prize are the sole responsibility of the Winners. Gallium Artists, Unity, and their respective affiliates, subsidiaries and advertising and promotion agencies, and each of their directors, officers, employees, agents and assigns, shall not be responsible for any such taxes, fees and costs. Limit of one prize package per Entry. To be clear an Entry cannot win multiple prize packages.
Potential winners will be required to complete and sign a declaration of eligibility and, except where prohibited, liability/publicity release or variations thereupon, in the forms provided by us, in order to claim prizes. If any potential winner does not complete the required forms as instructed and/or return the required forms within the time period listed on the notice the potential winner may be disqualified
If you are confirmed as a Winner of this Contest:
  • you may not exchange your prize for other merchandise or services. However, if for any reason an advertised prize is unavailable, we reserve the right to substitute a prize of equal or greater value;
  • if you are unable or unwilling to accept your prize you may not designate someone else as the winner;
  • if you accept a prize, we may be required to report the payments to the tax authorities and/or withhold taxes from such payment and remit to your tax authorities depending on the local tax rules. You will be solely responsible for all applicable taxes related to accepting Your prize; and
  • If you are a potential winner, we will notify you by sending a message to the e-mail address, the phone number, or mailing address (if any) on file with Unity Connect Profile, within ten (10) days following completion of judging. If the notification that we send is returned as undeliverable, your contact information is false, or you are otherwise unreachable or ineligible for any reason, we may disqualify you and award the prize to an alternative winner.
  • Any prize details not specified herein shall be determined solely by us.
Winner List and Award of Prizes. Winners will be announced at the Unity Developer Conference, Unite Berlin 2018 between June 19, 2018 and June 21, 2018 in Berlin, Germany.
Winners list (1) will also be posted online within 48 hours of the in-person announcement at SITE ADDRESS; (2) may be obtained by sending a self-addressed stamped envelope to Unity Technologies ApS, ATTN: Connect Team, Løvstræde 5, DK-1150 Copenhagen K, Denmark. Do not send any other correspondence to this address.
Winners may have their Entries and names posted on our respective media channels, including, without limitation, within their respective websites, Facebook pages, Twitter pages and/or blogs.
Except where legally prohibited, by participating in the Contest, the Winners hereby give us (including our advertising and promotion agencies) full permission, right and authority to use their likeness, photograph, name, hometown, and Entries, or any other information that they provide about themselves, the prize, the Contest, or us for the purposes of advertising and promotion (in any media, including but not limited to in print media, television, film, video, radio, internet or otherwise) related to us or the Contest, without any further notification or compensation to such Winners other than that set out herein.
Privacy Statement. By participating in this Contest, you acknowledge and agree that Unity may collect the personal information submitted by you, and use the information pursuant to these Official Rules (including sharing between Unity and Gallium Artists) and Unity’s privacy policy available at https://unity3d.com/legal/privacy-policy. If allowed under applicable law, you may exercise your right to access and modify your personal information which is stored by Unity by writing to privacy@unity3d.com and detailing your request.
General Terms.
  • Governing Law. Except where prohibited, you agree that any and all disputes, claims and causes of action arising out of or connected with this contest or any prize awarded shall be resolved under the laws of the State of California.
  • Decisions. All of our decisions regarding the application and interpretation of the Official Rules are at our sole discretion and are final.
  • Limitation of Liability. To the fullest extent permitted by applicable law:
By entering this contest, you agree that Unity, Gallium Artists, and their respective affiliates, subsidiaries and advertising and promotion agencies, and each of their directors, officers, employees, agents and assigns, shall not be liable for personal injuries, death, damages, expenses or costs or losses of any kind resulting from participation or inability to participate in this Contest or acceptance of or use or inability to use a prize or parts thereof including, without limitation, claims, suits, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light (whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory; and
You release Unity, Gallium Artists, and , and their respective affiliates, subsidiaries and advertising and promotion agencies, and each of their directors, officers, employees, agents and assigns from any and all liability and responsibility with respect to a prize (including any property loss, damage, personal injury or death).
You acknowledge that Unity, Gallium Artists, and their respective affiliates, subsidiaries and advertising and promotion agencies, and each of their directors, officers, employees, agents and assigns, have neither made nor are in any manner responsible for any warranty, representation or guarantee, expressed or implied, in fact or in law, related to a prize.
You waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages against Unity, Gallium Artists, and their respective affiliates, subsidiaries and advertising and promotion agencies, and each of their directors, officers, employees, agents and assigns.
Severability. In the event any Provision of these Official Rules prove unenforceable, void or incomplete, the validity of the other conditions will remain unaffected.
Sponsor. This contest is sponsored by Gallium Artistic Services Corporation dba Gallium Artists, a Delaware corporation having a principal place of business at 6053 Hyland Way, Penngrove, CA, 94951.
Host. This Contest is hosted by Unity Technologies ApS, a Danish corporation having its principal place of business at Løvstræde 5, DK-1152 Copenhagen K, Denmark, on behalf of itself and its Affiliates. As used herein, the term “Affiliates” shall mean an entity that directly or indirectly controls, is controlled by or is under common control with Unity Technologies ApS.
